Regulation (EU) 2022/868 of the European parliament and of the Council on European data governance (Data Governance Act)

The Data Governance Act is an important component of the European strategy for data, which aims to bolster the data economy. The aim is to set up robust mechanisms to facilitate the reuse of certain categories of protected public-sector data, increase trust in data intermediation services and foster data altruism across the EU.

The Regulation (EU) 2022/868 of the European parliament and of the Council of 30 May 2022 on European data governance and amending Regulation (EU) 2018/1724 (Data Governance Act) lays down:

  • conditions for the re-use, within the Union, of certain categories of data held by public sector bodies;
  • a notification and supervisory framework for the provision of data intermediation services;
  • a framework for voluntary registration of entities which collect and process data made available for altruistic purposes;
  • a framework for the establishment of a European Data Innovation Board.

The Regulation shall enter into force on 23 June 2022 and shall apply from 24 September 2023.
