Concessions and Control of the Activity of the Trade Associations and Government Enterprises Directorate:

1. Organizes and conducts the procedures for granting concession of railway infrastructure sights – state property, including the lands allocated for their construction, whole or technologically separate parts of ports for public transport of national significance and civil airports for public use;

2. Performs regulatory, coordinating, controlling and information functions related to concessioning;

3. Prepares documents and organizes the conduct of procedures for granting concession of sights under item 1 together with other directorates from the ministry;

4. Organizes and controls the contracts for granting concession under item 1;

5. Assists the Minister when exercising the rights of the state over the stocks or shares of companies in transport and communications sector, and in exercising his rights as a managing body of state enterprises in the area of transport and communications;

6. Analyzes the financial and economic conditions of the companies and state enterprises, in which the Minister represents the State at the general meeting or exercise the rights of the sole owner of the capital;

7. Prepares methodological development of business plans and financial recovery programs by companies and state-owned enterprises and provide methodological guidance on issues related to the economic and financial situation of the companies and enterprises under item 6;

8. Monitors the implementation of the economic indicators of business plans and programs under item 7; defines target economic indicators of business plans which are included in the contracts of the management and informs the Minister;

9. Monitors the implementation of the tasks assigned by the management and control of state the sole owned commercial enterprises and companies in which the Minister exercises the rights of the sole owner of the capital by conducting checks to perform tasks; informs the Minister about the results of the inspections;

10. Organizes the work of the collecting, storaging and using annual accounts of state enterprises and companies in which the Minister represents the State at the general meeting or the exercise the rights of the sole owner of the capital;

11. Аnalyzes the annual accounts, prepares statements and protocols for the adoption of the annual accounts, distribution of profits, giving tantiemes for the management bodies, the adoption of the reports of Public Accountants and the discharge of the managing bodies for the relevant financial year of sole trading companies in which the Minister exercises the rights of sole owner of the capital, and state-owned enterprises, in which the Minister represents the State in the general meeting;

12. Performs analysis of the reports of the State Financial Inspection Agency and, whenever needed, prepares proposals for sanctioning the managing bodies of the sole trade companies in which the Minister exercises the rights of a sole owner of the capital and in companies with majority state participation in the capital;

13. Organizes checks and ongoing monitoring of the sole trade companies in which the Minister exercises the rights of a sole owner of the capital and in trading companies with majority state participation in the capital and state-owned enterprises, in which the Minister represents the State in the general meeting, and assists in the contacts with the State Financial Inspection Agency, the tax administration, the National Social Security Institute and the National Revenue Agency;

14. Issues statements for the sole owned commercial companies with state participation in the capital on matters in which the Minister decides or authorizes under the Commerce Act and the Regulations on the procedure for exercising the rights of the State in commercial companies with state participation in the capital, approved with Decree № 112 of Ministers Council 2003 (amended., SG, issue 51 from 2003);

15. Compiles and maintains a register of the state enterprises and the sole owned commercial companies in which the Minister exercises the rights of a sole owner of the capital, and coordinates it with the National Statistical Institute;

16. Assists the Minister within his competence in the privatization of companies in the area of transport, information technologies and communications; interacts with the Financial Supervision Commission and the Privatization and Post-privatization Control Agency;

17. Prepares the acts for the transformation of trading companies;

18. Assists the Minister in conducting the policy of the Ministry with respect to trading companies in liquidation or bankruptcy, and with respect to state-owned enterprises;

19. Takes the necessary actions to recover the property rights, indemnification or compensation of the owners according to the Law for compensation of the Owners of nationalized property and the abrogated Law on Transformation and Privatization of State and Municipal Enterprises in relation with the transitional and concluding provisions of the Privatization Law and Post Privatization Control.
